Fr. Jaeger: some issues with the government difficult but resolvable

Jerusalem (AsiaNews) - Problems with visas, taxation of religious institutions, restitution of the Cenacle: Fr. David Maria Jaeger, an Israeli Franciscan, shared his views with AsiaNews, in his capacity as a jurist and expert on Church/State relations in Israel, on the central topics of an interview with Avraham Poraz, Israeli Interior Minister.
For Minister Poraz, problem with visas are "all but resolved", thanks to involvement from the Holy See which would vouch for visa applicants. But, for Fr. Jaeger, "In principle, from a juridical point of view, that of the rule of law, all norms regarding the issuance of entry visas and of residence permits must not be kept secret, but be officially published, so that applicants can refer to them in submitting their applications, in evaluating decisions and in considering any kind of recourse. It is clear, that in the middle term, the question will have to be the subject of negotiations and agreement, in accordance with the Fundamental Agreement between the Holy See and the state of Israel.
"The question has been on the bilateral permanent Commission's agenda since 1994, and it would be reasonable to presume that the Commission will deal with it in the next phase of talks."
Tax exemptions for religious institutions is another open question. The minister explained that places of worship are exempt from taxes, but not any commercial or hotel activities that may be connected to them. All such places should, in any case, pay for municipal services such as cleaning, water, etc...
"As far as is known, the Church has never demanded anything other than the recognition of vested rights; in other words, that its legal and tax conditions not worsen with respect to those under previous regimes. It is a matter of reconfirming a law that came into force in 1938, as well as legal and tax conditions that, by UN order, were to be maintained following the creation of the new state. However, just as discussions were taking place to record the contents of that law in the agreement with the Catholic Church (that is, in 2002), the Government drastically reduced the exemptions that were to be guaranteed to the Church. This was certainly not the purpose of the law, but one of its effects, which the agreement should now correct. Personally, I am optimistic about the outcome of negotiations, because I cannot imagine that, right after establishing official relations at the highest level, the Government of Israel would want to go down in the history of Church/State relations in the Holy Land for having worsened the legal and tax conditions of the Catholic Church on its national territory...It would be unthinkable, and that is why I trust the Government to conclude that it must make amends for the undesired effect of recent legislation, and that it is in the national interest to respect vested rights and the will of international institutions. Besides, the Catholic Church has never demanded any sort of exemption for purely commercial activities owned by the Church, if there are any in Israel, nor for the quantifiable consumption of utilities such as water or electricity, which are paid by everyone in proportion to actual consumption."
The minister also mentioned the return of the Cenacle and claims that the problem today "is a disagreement between Churches, on who is to take possession of it" and that the Government cannot enter into this disagreement.
"It's astonishing to hear talk of controversies between the Christian Churches," Fr. Jaeger affirms. "They have simply never existed, as far as the Franciscan Cenacle complex is concerned. Unlike the Nativity in Bethlehem and the Holy Sepulchre in Jerusalem, the Cenacle has never been "shared" or contested....its ownership was properly acquired by the sovereigns of Naples, Robert and Sancha, and, with the backing of Pope Clement VI, was donated to the Franciscan Order in 1342. The convent and sanctuary thus became the mother house of the Franciscan Custody of the Holy Land. It was the Ottoman Turks who, two centuries later, expelled the Franciscans by force. Since then, the Franciscans have always appealed for its return to their ownership, which has never belonged to any other Christian entity, whether Catholic or non-Catholic. And as far back as 1948, Israeli governments themselves have always recognized the Custody of the Holy Land as the sole official Christian interocutor for all questions regarding the Cenacle area. Thus, there has never been a controversy between Christian Churches, and there must never be one, unless someone provokes one in order to "divide and rule", as they used to say in the ancient Roman Empire."

The minister explained that measures for tax exemptions date back to the British Mandate. The question of tax measures is part of the agenda for the implementation of the Fundamental Agreement between Israel and the Holy See. "According to our laws -- Poraz explained -- places of worship (churches, synagogues, etc.) are exempt from taxes. If these institutions include shops or offer accomodations for a fee, then taxes can be levied. The only outstanding problem is concerning monasteries, where religious communities are housed. I have decided that they should not pay taxes, but pay only for municipal services, such as cleaning, sewage, water, etc. Municipalities need these taxes because otherwise they would not be able to offer such services."
Another matter mentioned by Poraz concerns the ownership of the Cenacle, once a property of the Franciscans, then of the Muslims and now of the Israeli government. On the occasion of John Paul II's visit to the Holy Sites in the Holy Land, there had been talk of the possibility of returning the place of Jesus' Last Supper to the Church.
Poraz said that "the problem today is a disagreement among the various Churches on who is to take possession of it. And Israel cannot enter into this disagreement. The Orthodox Church and Armenian Church have the right to pray there, together with the Franciscans. There are problems with the use of all the Holy Sites, but these are settled by the rules of the Status Quo. There are no such rules for the Cenacle. Everyone is expecting a decision from Israel, but there is no concrete decision yet."

The Bilateral Commission met yesterday. The joint communiqué speaks of "progress" towards an agreement in the making since 1999.

Jerusalem (AsiaNews) – The Bilateral Permanent Working Commission between the Holy See and the State of Israel met on Wednesday 18 February, at the seat of the Israeli Ministry of Foreign Affairs, to continue negotiating a treaty that would confirm the fiscal status of the Church in Israel, and safeguard her properties, especially the sacred places, as well as bring about restitution of some that have been lost over time. These negotiations began on 11 March 1999.
The convoy of motor vehicles with diplomatic number plates, with on board the negotiators for the Holy See, was seen arriving at the Foreign Ministry a little before 10 a.m., and leaving again a little before 1 p.m. The negotiators did not grant interviews, and only spoke, together with the Israeli Foreign Ministry, through a joint communiqué. Interest has been aroused by the fact that this time the communiqué speaks of "progress" that was achieved, beyond repeating the usual references to an atmosphere of "great cordiality" and to the shared determination to conclude the agreement "as soon as possible". For observers, the hope is thus being offered of further progress still before the arrival of Pope Benedict XVI who is expected to come to the Holy Land as a Pilgrim in May of this year.

In the case of Jerusalem, both aspects, the religious and the political and territorial, are closely linked, even though they are different in their constitutive elements, in the proper means of dealing with them and in finding a solution to them.
IV. What is the Holy See requesting for Jerusalem?
First of all. it asks that Jerusalem be respected for what it is in itself or rather what it should be, compared with what it actually is. That is what I defined a short while ago as the vocation or identity of the Holy City. Jerusalem is a treasure of the whole of humanity. In view of a situation of evident conflict and considering the rapid transformation of the Holy City, any unilateral solution or one brought about by force is not and cannot be a solution at all.
It is the view of the Holy See that every exclusive claim - be it religious or political - is contrary to the logic proper to the very City itself. I must insist: every citizen of Jerusalem and every person who visits Jerusalem should embody the message of dialogue, coexistence and respect evoked by the City. Exclusive claims cannot be backed up by numerical or historical criteria
Having said that, I must add that there is nothing to prevent Jerusalem, in its unity and uniqueness, becoming the symbol and the national centre of both the Peoples that claim it as their Capital. But if Jerusalem is sacred to Jews, Christians and Muslims, it is also sacred to many people from every part of the world who look to it as their spiritual capital or travel there on pilgrimage, to pray and to meet their brethren in faith. It is the cultural heritage of everybody, including those who visit it simply as tourists.
Consequently, the Holy See believes that there is an obligation to find a realistic solution to the problems of Jerusalem, to all of them, according to their particular characteristics.
There is a political problem concerning Jerusalem for Israelis and Palestinians first of all which is very practical. The Madrid Conference of 1991 and what followed gave birth to hopes of a peaceful future. Hopes founded on a willingness to talk, to negotiate and to seek to compromise. Hopes which appeared well-founded also by reason of the commitment and efforts of a large section of the international community, and in particular of the United States of America, as the events which took place at Wye Plantation in the last few days have demonstrated. Let us hope that the aspirations for dialogue and peace will contribute to the implementation of what has been agreed upon.
In this context, which is certainly both complex and delicate, the Jerusalem question has been placed at the bottom of the agenda. It is understandable that the difficulty and delicacy of the question of Jerusalem have meant that it has been left till last. But we all know, and the Israelis and the Palestinians are the first in this, that peace and coexistence in the Holy Land and Middle East have no future, unless an answer is found to the political question of Jerusalem. Allow me to quote once again from "Redemptionis Anno" of 1984, in which His Holiness Pope John Paul II wrote: "I am convinced that the failure to find an adequate solution to the question of Jerusalem, and the resigned postponement of the problem, only compromise further the longed-for peaceful and just settlement of the crisis of the whole Middle East."
What does the Holy See mean by an "adequate solution"? It means recognizing that the situation today is one of conflict. It means that Israelis and Palestinians, with the collaboration of all who can help them, have to reach an agreement which corresponds in some way to their particular legitimate and reasonable aspirations, and respects the principles of justice.
As far as the Holy See is concerned, however, the solution of a territorial dispute alone is not enough for Jerusalem, precisely because Jerusalem is an unparalleled reality: it is part of the patrimony of the whole world. And the whole world has shown that it is fully aware of this when, for example, through resolutions of the United Nations it has sought to defend that patrimony.
Looking to Jerusalem, the Holy See continues to ask that it be protected by "a special internationally guaranteed Statute". What is meant by this? In the Holy See's view:
the historical and material characteristics of the City, as well as its religious and cultural characteristics, must be preserved, and perhaps today it is necessary to speak of restoring and safeguarding those still existing;
there must be equality of rights and treatment for those belonging to the communities of the three religions found in the City, in the context of the freedom of spiritual, cultural, civic and economic activities;
the Holy Places situated in the City must be preserved, and the rights of freedom of religion and worship, and of access, for residents and pilgrims alike, whether from the Holy Land itself or from other parts of the world, must be safeguarded.
At stake is the basic question of preserving and protecting the identity of the Holy City in its entirety, in every aspect. For example, the simple "extraterritoriality" of the Holy Places, with the assurance that pilgrims would be able to visit them without hindrance, would not suffice. The identity of the City includes a sacred character which belongs not just to the individual sites or monuments, as if these could be separated from one another or isolated from the respective communities. The sacred character involves Jerusalem in its entirety, its holy places and its communities with their schools, hospitals, cultural, social and economic activities.
Israelis and Palestinians, in the desired search for a political settlement of their conflict over Jerusalem, cannot overlook the fact that the City has aspects which go far beyond their legitimate national interests. They, therefore, have to take these aspects into consideration in looking for and in reaching a lasting political and territorial solution. In the same way, they will not be able to avoid giving due consideration to the efforts and demands of all legitimately interested parties. In this, Israelis and Palestinians must not feel in any way restricted, but rather honoured and reassured.

Putin's trip to Italy also has a religious-political dimension that should not be overlooked since it is also his first visit to the Vatican. For the Russian president meeting Benedict XVI reflects a desire to have the Vatican on his side in the great strategic game that is being played out on the energy, political, ideological and religious fields. Support from the Church of Rome would help Putin dismiss European and US criticism over Russia's human rights record, its political use of energy supplies and its reticence vis-à-vis sanctions against Iran. It would also reduce the country's historic fear of encirclement.
This is especially true in the Middle East, where Putin like his predecessors probably views Russia as the traditional protector of Christian Orthodoxy in the Holy Land, and wants to break its isolation by preventing the Vatican from aligning itself to the staunchly pro-Israel positions of the US right. This way Russia would not have to make compromise with Islamic fundamentalism which Russians, too, view as a danger.

Since then Vatican officials, notably Secretary of State Cardinal Tarcisio Bertone, have been frustrated at the slow pace of negotiations and the road blocks thrown up by the Israelis. One such particularly thorny issue was the sudden 2007 revocation of visas to religious personnel not born in Israel, cutting off hundreds of priests and religious from their work in the Holy Land. On Jan. 16, 2008, the Israeli Interior Minister announced that, while taking into consideration the security issue, Israel will now make a "concession" of restoring such visas.
Recently, Israel's Holy See ambassador, Oded Ben-Hur claimed that his government was very close to finalizing the full pact--85% agreed, he said. But such statements have been heard before. Pope Benedict would like to pay an official visit to Israel, but he is unlikely to do so until the Fundamental Agreement is signed and sealed. The Vatican has said that it will attend the controversial UN anti-racism conference in Geneva next month ('Durban Review Conference', or 'Durban II') but hoped for a change in the wording of its final declaration."People go to conferences to discuss and debate," Vatican spokesman Federico Lombardi was quoted as saying by the Reuters news agency. He added: "That doesn't mean we agree with the draft text of the final declaration as it is now." Both Italy and the United States have said that they will not attend unless the wording of a document they consider hostile to Israel is altered before the gathering starts. Lombardi said the Vatican's representative in Geneva had "made it clear that the Vatican is opposed to all forms of discrimination, whether it is against an individual, a religion or a state." The Vatican has permanent observer status at the United Nations, but is not a member state.....

After the Pope made the official announcement of his visit to the Holy Land during last Sunday's Angelus, today the Catholic Ordinaries of the Holy Land's Assembly held a press conference to inform journalists about the journey and give some details. At the press conference, it was announced that "the Pope will lay the foundation stone of an international family centre. Always in Nazareth, the Pope will celebrate an open-air Mass. Forty to fifty thousands faithful are expected to attend. Other open-air Masses are going to be held in Jerusalem, in the Cedron Valley, with an expected attendance of 5,000 faithful, and in Bethlehem." Benedict XVI will pray in the Cenacle and in the Holy Sepulchre. The ecumenical programme includes some meetings at "the Greek-Orthodox and Armenian-Orthodox Patriarchate in Jerusalem." On the inter-religious side, "the Pope's meeting with the Grand Mufti of Jerusalem, his visit to the Dome of the Rock as well as his prayer at the Wailing Wall and at the Rabbinic centre of Jerusalem - near the central synagogue - have all been confirmed. Among the requests the Israeli government "has promised to satisfy", there is "the possibility for a Christian delegation to come from Gaza, where two buses have already been allocated to drive the faithful to Bethlehem for the Mass."

"It is not fitting to enter the Western Wall area with religious symbols, including a cross." According to Rabbi Shmuel Rabinovitch, who is responsible for worship matters at the Western Wall, Benedict XVI should not wear the cross during his visit to the Western Wall, scheduled for 12 May as a part of his journey to the Holy Land. The Rabbi's declarations, published today by Jerusalem Post, were followed by a clarification by Mordechay Lewy, Israeli Ambassador to the Holy See. A statement that has just been released reads: "The Ambassador of Israel to the Holy See, H.E. Mordechay Lewy, believes it necessary to clarify that during the next visit of Pope Benedict XVI to the Western Wall, the same procedure that was applied in the Papal visit of the year 2000, will be valid. The Israeli host will respect, as a matter of course, the religious symbols of the Holy Father and of his entourage, as expected in accordance with rules of hospitality and dignity. This was confirmed to a high Official of the Ministry of Foreign Affairs of Jerusalem personally by Rabbi Shmuel Rabinovitch, who is responsible for worship matters at the Western Wall. This clarification was deemed necessary as today - 17 March 2009 - the Israeli daily "Jerusalem Post" published a misleading quotation of the rabbi."

500 hours of classes to explain the figure of the Pope and the history of both the Church and the Vatican to the students of the Christian schools in Israel. This is what the local government decided in order to prepare the next visit of Benedict XVI to the country, for which 43 millions of shekel had been allocated, against 30 millions that had been allocated to John Paul II's visit in 2000. This is what parish priest of Jerusalem Father Ibrahim Faltas, an assistant in the Catholic schools of Jerusalem, explained to the SIR. "It is about some lessons on this issues aimed at pupils attending Christian Catholic schools, including Muslims," explained the Franciscan Father. The news is confirmed by Father Elias Daw, President of the court of appeal of the Melkite Greek Catholic Church. With its 60 thousands faithful, this church is the biggest church of Israel. "This initiative is showing Israelis' expectations for the papal visit. This journey comes in a delicate moment, after the tragedy of Gaza, the recent attacks against the symbols of our religion on an Israeli TV channel and the declarations made by Holocaust-denying bishop Williamson," he said to the SIR. Christians in the Holy Land need the Pope and his voice of truth and justice now more than ever." In Israel, there are 44 Catholic schools attended by 24,000 students both Muslim and Catholic.

10:16 - CHARLEMAGNE PRIZE: 2009 EDITION TO ANDREA RICCARDI
The Charlemagne prize 2009 was awarded to Andrea Riccardi, the founder of Saint Egidio Community. The news is reported by the Saint Egidio Community itself. Tomorrow, 5 March, the Community will hold a press conference (5pm. at piazza S. Egidio 3 in Rome) in which Jürgen Linden, Aachen's mayor, and Walter Eversheim, spokesman of the Charlemagne Prize Board of Directors, will meet Riccardi to give him the official news of his award. We decided to bestow the prize on Andrea Riccardi "to hail him as a great European who has put his life at the service of the neighbour, in the best sense of the term, for his passionate commitment to supporting understanding and dialogue between people of every religion and nationality and for the Saint Egidio Community is giving an outstanding contribution to a more peaceful and fair world, which is an extraordinary example of civil commitment for a more human and united Europe both within and outside its borders," the board explained. The prize will be bestowed on 21 March during an official ceremony which will be held in the coronation hall of Aachen town hall. Among the winners of past editions: Angela Merkel (2008), Carlo Azeglio Ciampi (2005), Bill Clinton (2000), Tony Blair (1999), Frère Roger Schutz, Taizé (1989), and before them, Robert Schuman, Winston Churchill, Konrad Adenauer, Jean Monnet e Alcide de Gasperi.
