בענין מכירת/השכרת נכס מקרקעין לנוכרי בארץ ישראל בזמן הזה

 

בישיבת בית הדין מיום י"ד באב תשס"ט עלתה עתירתו  של מר אריה קינג ראש הקרן לגאולת קרקעות בארץ ישראל. בפנייתו לבית הדין של הסנהדרין בקש שביה"ד יפסוק בשאלה האם מותר ליהודי למכור או להשכיר דירה או נכס מקרקעין לגוי.

 

השאלה התעוררה על רקע של העברות בעלות, מכירה השכרה והעברת השליטה והחזקה מיהודים לגויים  בשכונות ירושלמיות בערי הלווין של ירושלים ובכל הארץ. [בין אם על ידי  יהודים פרטיים בין על ידי תוכניות מתאר ממשלתיות  שהוקפאו בינתיים או גם בהעלמת עין של השלטונות מהשתלטות ערבית פלילית]

 

  בשנים האחרונות רווחת התופעה של ערבים הרוכשים מקרקעין/דירות בשכונות שבערים המאוכלסות ביהודים ובדרך זו קונים אט אט חזקה על שכונות יהודיות שמתעצמת עד כדי הליכי קניית חזקה על  ערים שלמות. כך זה  בנצרת עלית, כרמיאל, עכו , יפו, נהריה רמלה ולוד  ואף באזורי ספר ירושלים.  כמו כן ערבים השתלטו ומשתלטים בצורה פלילית בתפיסת שטחים לא להם ואף באיומים ופגיעה ברכוש ובגוף על אנשים פרטיים. כך נתפסו כבר מאות אלפי דונם בנגב ובגליל ונבנו בהם רבבות מבנים בלתי חוקיים. תנופה לאומנית זו, זוכה לתמיכה כלכלית, פוליטית, והסברתית מגורמי חוץ העויינים את העם היהודי ואת מדינתו  ואף לדאבון הלב  זוכה תנופה זו לתמיכה במפורש או בהעלמת עין מכוונת מגורמים מתייוונים מזרע ישראל, בעלי השפעה ומעמד במוסדות השלטון ובבתי המשפט. יש מהם הזוכים עקב כך לטובות הנאה מפליגות בקשריהם עם גורמים זרים. יש לראות בעסקאות המעבירות רכוש יהודי לערבים עסקאות בעלות אופי לאומי מובהק. שלב בגירוש עם ישראל מארצו, ארץ ישראל, היה לא תהיה.

 

תהליך הנישול של יהודים משכונתם מתרחש בדרך הבאה:

בצעד ראשון ערבים קונים או שוכרים דירות בודדות בשכונה יהודית על ידי הצעת תמורה גבוהה לבעלים יהודי הנושא עיניו לתמורה הכספית הגבוהה מהתמורה שמציעים יהודים.  המקורות לתמורה הכספית הגבוהה יותר המוצעת הינם בין השאר:

1. אפליה בגביית מיסים באשר רשויות המס חוששות לגבות מס אמת (מס הכנסה, מ.ע.מ. ביטוח לאומי, ארנונות וכיו"ב, כפי שהעיד על כך ניצב אלק רון במהומות האחרונות) במיגזר הערבי מחשש למרי אלים.. כתוצאה יש למיגזר הערבי כסף פנוי רב שאין למיגזר היהודי.
2. כספים מגורמי חוץ כמו מדינות הנפט הערביות ואף תמיכה זרה במישורים המדיניים המשפטיים וכיו"ב.

בצעד השני מתחילה להתרחש עזיבת יהודים ומכירה מתגברת, תוך ירידות מחירים מתעצמות של נכסים בבעלות יהודית, לידי ערבים, באשר היהודים  חוששים, מהתנהגות מסכנת (מחסה לטרור ועבריינות).

בצעד השלישי נאלצים התושבים היהודים הרבים שנותרו למכור נכסיהם במחירי הפסד  מחמת הלחץ הפלילי המתגבר , הכוללים הצקה לצעירות ואף מעשי  חטיפה  ואונס מתגברים, כאשר המשטרה ורשויות המשפט, מתקשות להשליט את החוק לשמירת שלומם ורכושם של התושבים.

אנשי הקהילה היהודית במקום,  ניזוקים קשה מחמת מעשיהם של בודדים שפתחו בתהליך.

 

פסק:  בית הדין

 

עם ישראל מצווה לרשת את הארץ, ארץ חמדת אבות, לעובדה ולשומרה ולקיים בה את כל המצוות התלויות בארץ ולא לעוזבה בידי זולתינו.

"ארץ ישראל נקנית ביסורים" (מסכת ברכות ה,א) וכך מוסבר שם : "ארץ ישראל, שכתוב, 'כי כאשר ייסר איש את בנו ה' אלקיך מיסרך' וכתוב אחר כך 'כי ה' אלוקיך מביאך אל ארץ טובה'."

לפיכך גם אם בנסיונות של היום מאבד יהודי ממון רב בכך שאינו מתפתה למכור נכסיו לגוי הרי שהוא עומד בנסיון והרחמן ימלא חסרונו.

ככל שמתעצם המאבק הלאומי בין ישראל לבני ישמעאל ובני עשו בכל כינוייהם קיבל המסחר במקרקעין משמעות מדינית כבדת משקל,  בנסיבות אלו יש להחמיר מאוד בענין עסקאות דלא ניידי עם נכרים כיוון שהנוכרי אינו נושא ונותן רק לעצמו אלא גם לעמו/דתו. לכן כל יהודי שמשכיר או מוכר דירה או מקרקעין לנוכרי במקום שגרים בו ישראל, כמו בית מגורים משותף, בית אחוזה שיש לו שכן יהודי, שכונה, עיר או שטח חקלאי מסייע במעשהו

לרדיפתם של בני עמו הנותרים. והרי הוא נתפס בדיעבד בעוונות הקשים של מסירה רדיפה ובגידה.

מעשה זה מלבד היזקו ליהודים במקום מערער ריבונות העם היהודי על ארצו.

 

1. מצווה מיוחדת היא לגאול את קרקעות ארץ הקדש כאמור בנצי"ב ויקרא כ"ה כ"ד. ומצוה זו דוחה אף לעיתים את השבת באיסורי חכמים( כביאור הגר"א על שלחן ערוך חושן משפט סימן קצד ס"ק א.)
2. בענין מכירת/השכרת מקרקעין לנוכרי יעויין במקורות הבאים המצורפים להלן אשר חלקם צרפנו לנוחיות הדן בסוגיא (בסוגריים נוספו מילות הסבר וקישור).

 

א) דעת הר"מ (הרמב"ם) דכיון דאין אנו מקבלים אותו כגר תושב לא הותרה ישיבתו בארץ אע"ג שהוא זהיר בשבע המצוות דבלא קבלה אין אנו בטוחים בזהירותם ואין אנו בקיאים בהם אבל דעת הראב"ד דכל שהוא נזהר בשבע מצוות דראוי לקבלו אלא שמפני הקושי נפטרנו מקבלתו ומחיוב להחיותו שלא ינהרו כולם לארץ מכל מקום אין איסור בישיבתו שאין כאן חשש פן יחטיאו וגו'... ואף לדעת הראב"ד דווקא שהוא שלם באמונת ישראל שישראל נתחייבו בתרי"ג מצוות ובן נוח בז' אבל אם יש לו דעות כוזבות והוא משועבד לדעותיו אף שאין בהן עבודה זרה ממש וגם הוא שומר ז' מצוות מצד היושר (כיוון) שאינו ראוי לקבלו כגר תושב הרי הוא באיסור לא תחנם ובאיסור ישיבה (בארץ) דקרינן בהו פן יחטיאו בכפירותם (דבר זה גורם בין השאר לנישואי תערובת).

 

ב) מתוך דברי הרב אייזיק הלוי יצחק הרצוג חוקה לישראל סדרי שלטון ומשפט, מוסד הרב קוק, תשמ"ט עמ' 16 - 15  עולה:

"אבל אם נשקפת מצד זה [קבלת גרים תושבים מוסלמים והענקת חניה להם בקרקע] סכנה של נישול ישראל מקרקע ארץ ישראל,..., (לפיכך) כל יהודי המוכר קרקע לנכרי ואפילו לערבי מוסלמי הוא מערער יסודות התאחזותנו בארץ אבותינו ומשים מכשולים על דרכנו לגאולת  הארץ והעם ועוכר ובוגד יקרא,

 

ג) ההלכות להלן נאמרו בחו"ל וחומרותיהן בוודאי שתהיינה נכונות לארץ ישראל)

חו"מ ח"ג קע"ה סעיף מ, מא: המוכר לגוי או השוכר לו משמתין אותו עד שיקבל עליו כל אונס שיבוא מן הגוי,  עד שינהוג הגוי עם בן המצר שלו בדיני ישראל בכל, ואם אנסו בדבר, שלא כדין ישראל, משלם המוכר. ואם בא לו היזק מכוח שכונת הגוי בחיי המוכר ומת, חייב הבן לשלם ממה שירש מאביו במה דברים אמורים כשיכול למוכרה או לשוכרה לישראל, בדמים שנותן הגוי, אבל אינו חייב למוכרה לישראל בפחות, (היתר זה רק בחוץ לארץ אבל בארץ ישראל אסור למכור לגוי בשום ענין), ואי חזינן שהגוי, מכוין לקנות במצר ישראל עד כדי להשחית נחלתו, הכל לפי ראות הדיין.

והסמ"ע הוסיף שאפילו בחו"ל ששם אין איסור לא תחנם, עם כל זאת אם הגוי מעלה את המחיר באופן ניכר מעל למחירי השוק אסור למכור לו באשר כוונתו הינה ליצור השתלטות על מקום באזור היהודי. וזו לשונו -

סמ"ע:  ע"ג שם: ולא כשהגוי מעלה בדמים הרבה יותר מהסדר אז צריך למוכרו לישראל בדמים השווים.

 

לכן בית הדין של הסנהדרין אוסר באיסור חמור ומוחלט על יהודים למכור להחכיר או להשכיר או להעניק חזקה במשתמע בכל צורה שהיא לנוכרי בארץ ישראל בזמן הזה.

על היהודי בעל הנכס או חוכרו לנקוט בשמירה מעולה על הקרקע כדי שלא ישתמע שהתעלם או העביר קרקעות לשליטת נכרים.

השכרת נכס מקרקעין לאינו יהודי, המסכן את היישוב היהודי, היא  מעשה בגידה בתורה ובעם הקודש. מעשה זה הינו מעשה מסירה, מסירה של נכס לאומי ממדרגה ראשונה לידי זרים.

איש יהודי כזה המעביר חזקת קרקע לגוי, מיום פרסום פסק זה, לא יוכל לשמש כשליח ציבור, לא ראוי לצרפו למנין מתפללים ובוודאי שאין להעלותו  לקריאת ספר תורה.

 

בית הדין מודע למקרים חריגים כגון השכרת חדרים בבתי מלון לתיירים סכנת חיים ליהודי בודד וכיו"ב. בכל מקרה כזה יהיה על המעוניין במסירת החזקה לפנות לבי"ד בלתי תלוי ולבקש התייחסות מפורשת בכתב מראש, למעשה אשר יעשה.

 

בשולי הפסק

בית הדין מוצא לנכון להתייחס למקורה הראשי של הבעיה המתפתחת הזו, היינו אי קיומה של המצווה הראשונה בתורה כאמור בתורה (בראשית א כ"ב)-... פרו ורבו ומלאו את הארץ.... וכפי האמור בדברי הנביא (ישעיה מ"ה י"ח) ...לא תהו בראה שבת יצרה... שמצווה להוסיף ולהרבות בצאצאים. בית הדין קורא לבני עם הקודש להקים משפחות גדולות, להימנע כליל מדחיית מועד הנישואין, ולהתחתן מוקדם ככל האפשר.

WASHINGTON, Aug 18 (Reuters) - A new kind of influenza vaccine works against the new swine flu virus in animals, Novavax, Inc. (NVAX.O: Quote, Profile, Research, Stock Buzz) reported on Tuesday.

The company said it made the vaccine, which uses so-called virus-like particles, in fewer than four weeks after the U.S. Centers for Disease Control and Prevention released the genetic sequence of the H1N1 swine flu virus, which is now causing a pandemic.

These virus-like particles are a mock version of the virus, made using the genetic sequence.

Novavax said the vaccine protected ferrets against the new pandemic strain. Ferrets are the closest animal to humans when it comes to being infected with influenza.

"The ferrets received a 3.75, 7.5, or 15 microgram dose of the 2009 H1N1 virus-like particle vaccine or a placebo and were boosted with a second dose after three weeks," the company said in a statement.

Researchers at the CDC infected the animals with H1N1 taken from a California patient. "By day five after challenge, immunized ferrets at all vaccine dose levels had cleared the H1N1 virus and showed no sign of disease," the company said.

"In contrast, control animals that received no vaccine displayed lethargy, elevated body temperatures and shed infectious virus for up to six days post-infection," it added.

Novavax would have to get U.S. Food and Drug Administration approval before it could test its new vaccine in people. Years of testing are likely to be required before such a new formulation of a vaccine could be widely used in people.

OLD FASHIONED TECHNOLOGY

Clinical trials of H1N1 vaccine made the old-fashioned way, with chicken eggs, are under way, and five companies are making it for the U.S. market -- AstraZeneca's (AZN.L: Quote, Profile, Research, Stock Buzz) MedImmune unit, CSL, GlaxoSmithKline Plc (GSK.L: Quote, Profile, Research, Stock Buzz), Novartis AG (NOVN.VX: Quote, Profile, Research, Stock Buzz) and Sanofi-Aventis SA (SASY.PA: Quote, Profile, Research, Stock Buzz).

Novavax Inc., based in Rockville, Maryland, has been using its new technology to develop a vaccine against H5N1 avian influenza.

Most influenza vaccines use either a weakened but live flu virus or a killed virus to stimulate the immune system. They must be reformulated every year to match the constantly mutating flu strains and take five to six months to make using specially grown live chicken eggs.

Novavax grows the vaccine in lab dishes of caterpillar cells in a process the company says is quicker. It uses a decoy of the virus called a virus-like particle. The body recognizes the particle as a virus but it cannot infect cells and replicate.

The World Health Organization declared H1N1 a pandemic in June, and the virus has spread to about 180 countries. World health officials have said people should receive the two-dose swine flu vaccination as well as the single-dose seasonal flu vaccination this year.

In July, U.S. advisers said about half the U.S. population, or 160 million people, should get vaccinated against the new pandemic influenza strain, with pregnant women and healthcare workers at the front of the line.

But the U.S. Health and Human Services Department has said it can only get about 45 million doses of flu vaccine by mid-October, and about 20 million doses a week after that.

Swine Flu Shots May Be Too Little, Too Late to Halt Outbreaks

Aug. 19 (Bloomberg) -- Swine flu vaccines under development by drugmakers may not provide immunity until the last week of November, too late to hold off outbreaks triggered by infected students returning to schools in the U.S. and Europe.

Just 45 million of 195 million doses ordered for the U.S. will be delivered by mid-October, said health officials who lowered their estimates yesterday. The vaccine will probably require two shots given three weeks apart, and the body won't produce antibodies for two additional weeks, according to an Aug. 7 report by the Department of Health and Human Services.

U.S. students go back to school this week after more than 80 outbreaks of swine flu, also known as H1N1, were reported in summer camps, government health officials said. U.K. classes begin Sept. 1, a week before results from the first test of the new vaccine are set to be released by CSL Ltd., the Australian drugmaker that makes 20 percent of the U.S. supply.

"This has been a virus that's been smoldering, particularly among children at the many summer camp outbreaks," said William Schaffner, of the Vanderbilt University School of Medicine. "There's no doubt it's coming, and we could see it as early as September. Every pediatrician, internist and public health official is cross-eyed" with worry, he said.

Swine flu infection won't protect patients from seasonal influenza, so the coming season may be "double-barreled," marked by successive rounds of illness, Schaffner, chairman of the Nashville, Tennessee school's department of preventive medicine, said in an interview.

170 Countries

H1N1 has reached more than 170 countries and territories in the four months since being identified, the Geneva-based World Health Organization said. Swine flu causes similar symptoms as seasonal strains. It has so far resulted in "slightly worse" than normal flu seasons, with increased hospitalizations and cases of severe illness, the WHO said in an Aug. 12 release.

The median age of those with the pandemic virus has been 12 to 17 years, the WHO said on July 24, citing data from Canada, Chile, Japan, U.K. and the U.S.

Patients who have already had swine flu will be immune to it in the fall, Schaffner said. Recovered patients shouldn't count on having immunity unless their illness was confirmed by laboratory tests. If they weren't tested, they should get the vaccine to ensure they're protected, he said.

Sanofi-Aventis SA, based in Paris, began vaccine trials on August 6 and needs "two to three months" to complete them, said Donna Cary, a company spokeswoman, in an e-mail yesterday. London-based GlaxoSmithKline Plc and AstraZeneca Plc both have said they began testing in the last two weeks.

Required for Licensing

The company tests are required for licensing and are separate from U.S.-funded studies to determine dose and timing of the vaccine, said Bill Hall, a spokesman for the U.S. Department of Health and Human Services.

The U.S. will receive 45 million vaccine doses by mid- October, and get an additional 20 million each week until its full order of 195 million doses from five companies has been received, Hall said.

CSL, based in Melbourne, is delaying its shipment to the U.S. to speed up shots to people in the company's home country, Hall said in a telephone interview yesterday. All U.S. shots are provided by companies based outside the U.S.

"I can confirm that CSL's first commitment is to Australia," said Sheila Burke, a spokeswoman for CSL, in an e- mail yesterday.

Rapid Outbreaks

Australia and nations in South America had rapid outbreaks early in their winter season, and rates in those countries have begun to recede this month, the WHO said. South Africa was the biggest exception in the hemisphere, being struck first by seasonal flu strains that peaked in June, and only recently experiencing a second wave dominated by H1N1, the WHO said.

Companies haven't been able to grow enough antigen, a key ingredient needed for production, to fill vaccine orders, said Rachel David, a spokeswomen from CSL, and Kim White, a spokeswoman for Baxter International Inc. in telephone interviews last week.

"It's apparent that the vaccine availability is going to be delayed, and that the number of doses available is going to be less," said Gregory A. Poland, head of the vaccine research group at the Mayo Clinic in Rochester, Minnesota, in an Aug. 14 telephone interview. "Right now they are getting yields of about 50 percent roughly of what they expected."

Information about the required dose of vaccine and number of shots needed probably won't be complete until late September, said Marie-Paule Kieny, director of the WHO's initiative on vaccine research, in a telephone interview from Washington yesterday.

Protection Priorities

Authorities want to ensure adequate supplies to protect health-care workers, pregnant women, people at risk of developing severe complications from flu and children, whose close contact in tightly packed schoolrooms and in other social settings makes them the biggest spreaders of the virus.

Part of the U.S. plan to vaccinate children is to encourage state and local health departments to set up school-based vaccine clinics. In the U.K., most shots will be given by family doctors and nurses who provide routine health care including seasonal flu shots, according to the Department of Health.

Schools that arrange in-house immunizations will face logistical hurdles, said Mel Riddile, the National Association of Secondary School Principals' associate director for high school services in the U.S. Riddile, a former principal at a Fairfax County, Virginia, high school, said it typically took a month just for all 2,500 students to turn in their emergency medical information forms at the beginning of the school year.

Immunization Permissions

"It's going to be difficult getting immunization permissions, particularly with some of the misconceptions about the effectiveness and the dangers around flu shots," Riddile said in an interview Aug. 7. "It certainly can be done, but it's going to be challenging for principals to pull that off."

Charles Saylors, president of the National Parent Teachers Association, the non-profit organization that helps organize parents and teachers in local PTA groups, said that even though he has never before received a shot for seasonal flu, he'll get one for H1N1 when it becomes available.

"I would like to see our communities, our families take this more seriously than they normally would a regular seasonal vaccine," Saylors said.

During the initial U.S. outbreak, hospitals saw a surge of patients that were either seriously ill or concerned about the virus. The federal government is now working with communities to encourage that only the sickest go to hospitals, with the rest making appointments with doctors or clinics, the HHS's Kevin Yeskey said.

"What we saw in the springtime was a lot of people who were referred directly to an emergency department rather than being seen in clinics," said Yeskey, director of the Office of Preparedness and Emergency Operations. "That kind of overwhelmed" the hospitals, he said.

It may be an analogue to the earlier British commission on population from 1944. The memo lists 13 countries to be targeted for depopulation. Using the World Bank and the IMF to directly pay the governments of these countries to reduce population, or perhaps use food and war as means of reduction.
